Section 1Who we are and what these Terms cover

Fifth Wheel is operated by Fifth Wheel Supper Club, LLC, a Georgia limited liability company doing business as Fifth Wheel (“Fifth Wheel,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of our website, application forms, text messages, and the curated dining events we organize (together, the “Service”).

Fifth Wheel curates evenings for five verified single guests. A single evening moves through three stops in one Atlanta neighborhood — drinks, dinner, and dessert — and closes with a private, anonymous mutual-interest vote. We are the organizer of that evening. We are not a restaurant, a bar, a caterer, a transportation provider, a matchmaking agency, or a background-screening service.

By submitting an application, accepting a seat, paying a reservation fee, or attending an event, you agree to these Terms. If you do not agree, do not use the Service.

Section 2Eligibility

To apply for or attend a Fifth Wheel evening, you must:

• Be at least 21 years of age;
• Be legally single and not presenting yourself as available under false pretenses;
• Be able to attend events in the metropolitan Atlanta area;
• Complete our identity verification requirements (Section 4);
• Have never been removed from the Service for a conduct violation; and
• Maintain one account and one identity on the Service.

We may verify eligibility at any time and may decline or revoke access if we cannot confirm it.

Section 3Application, curation, and seat offers

Applying to Fifth Wheel does not reserve a seat and does not guarantee placement at any evening. Every table is assembled by a human coordinator. There is no algorithm, no queue position, and no entitlement to a seat based on the order or timing of your application.

When a coordinator builds a table you fit, we will send you a personal invitation containing the date, neighborhood, approximate timing, and a link to confirm and pay. Invitations expire on the deadline stated in the invitation. Your seat is reserved only when payment is completed.

Curation criteria

Coordinators consider stated availability, neighborhood, age band, and the conversational balance of the group. We do not guarantee any particular composition of the table, any particular number of guests you will find compatible, or any particular outcome from the evening. Any themed or topical element of an evening is a conversation framing only and is never used to determine who may attend.

We may decline an application, decline to seat you at a specific table, or discontinue seating you entirely, at our discretion, subject to applicable law. We are not obligated to give reasons.

Section 4Identity verification

Verification is the foundation of the format. Every guest at every table completes it. Verification may include confirming a mobile number by one-time code and confirming a government-issued photo ID through our third-party identity verification provider. You agree that the information you submit is true and belongs to you. Submitting another person’s identity documents, an altered document, or a photograph of a photograph is grounds for immediate and permanent removal without refund.

Section 5Reservation fees and what they include

Reservation fee

A confirmed seat costs $25.00 per person, per evening, charged at the time you accept your invitation. Payment is processed by our third-party payment processor; we do not store your full card details.

The reservation fee covers curation, verification, coordination with the three venues, and running the evening — including reserved space at each stop and the mechanics of the vote.

The reservation fee does not include food or drink. You are responsible for your own food, beverages, tax, and gratuity at each of the three stops, paid directly to each venue. Prices are set by the venues, not by us. Bring a form of payment. You are also responsible for your own transportation, parking, and any other personal costs of attending.

Fees are stated in U.S. dollars and are exclusive of any applicable taxes, which will be added where required.

Section 6Cancellations, changes, and no-shows

A Fifth Wheel evening is built for exactly five people. When one guest withdraws late, the coordinator does not simply lose one seat — the table’s balance is broken for four other verified guests who have already arranged their evening. Our refund terms are firm for that reason, and they are the same for everyone.

If you cancel

If you accept an invitation less than six (6) hours before the event, your reservation fee is non-refundable from the moment of purchase. This is disclosed again at checkout.

Refunds are issued to the original payment method and typically post within five to ten business days. Refund tiers are measured against the published start time of the first stop, in Eastern Time, and are determined by when we receive your cancellation through the link in your confirmation.

Repeated late cancellation

Two late cancellations or no-shows within a rolling twelve-month period may result in removal from future seating. This is not a penalty fee; it is a seating decision.

Emergencies

We may, at our sole discretion and without setting a precedent, make an exception in the case of a genuine emergency. Any such exception is a courtesy, not an entitlement, and does not modify these Terms.

Transfers

Seats are personal to you and may not be transferred, sold, gifted, or given to another person. Every guest at the table must be individually verified and individually curated.

Section 7Changes or cancellation by Fifth Wheel

We may substitute a venue, adjust timing, or change the running order of the evening. Where a change is material, we will notify you as far in advance as we reasonably can.

If we cancel an evening for any reason — including a venue closure, a table that falls below the minimum number of guests, weather, or a safety concern — you will receive a full refund of your reservation fee, or the option to be seated at a future evening at no additional cost. That is our entire obligation to you in the event of a cancellation by us. We are not responsible for your travel, childcare, wardrobe, cancelled plans, or other incidental costs.

If a guest withdraws close to the event and we cannot replace them, we may run the evening with four guests, seat a substitute, or cancel. An evening that runs with fewer than five guests is not a cancelled evening and does not entitle you to a refund.

Section 8Conduct at the table

The format only works because everyone at the table has agreed to the same terms. While using the Service and while attending any event, you agree that you will not:

• Harass, threaten, demean, or intimidate any guest, host, or venue staff member;
• Make unwanted physical contact, or continue any advance after it has been declined;
• Photograph, film, or record another guest without that guest’s express permission;
• Share another guest’s name, image, contact details, employer, or personal information outside the table;
• Attend under the influence to the point of disruption, or become disruptive during the evening;
• Use the evening to sell, recruit, solicit investment, promote a business, or gather leads;
• Attend while married, partnered, or otherwise unavailable, without disclosing that fact; or
• Violate any venue’s own rules, dress code, or instructions from its staff.

A coordinator or host may end your participation in an evening at any time if your conduct warrants it. If you are asked to leave, you leave, and no refund is due.

Section 9The vote and mutual interest

At the close of the evening, each guest privately indicates who, if anyone, they would like to be introduced to. Votes are anonymous. We disclose a vote only where interest is mutual, and only to the two guests involved. If no match results, no one is told who voted for whom, and nothing is disclosed to the rest of the table.

If a match results, we share the two guests’ first names and the contact method each has designated. What happens after that introduction is entirely between the two of you and is outside the Service.

You may decline to vote, and you may withdraw a match before contact information is exchanged by telling us before the exchange occurs. A match is an introduction, not a commitment, and carries no promise about the other person.

Section 10Alcohol and personal responsibility

Alcohol may be available for purchase at any of the three stops. Fifth Wheel does not sell, serve, supply, or provide alcohol, and no alcohol is included in your reservation fee. All alcohol service is performed by the licensed venue, subject to its own policies and Georgia law.

You are solely responsible for your own consumption and for arranging safe transportation to and from every stop. Do not drive impaired. If you appear intoxicated, a venue may refuse you service and we may end your participation in the evening, without refund.

Section 11Allergies, dietary needs, and accessibility

Fifth Wheel curates restaurant partners with the goal of offering menus that can accommodate a range of dietary preferences, including vegetarian, vegan, and gluten-free options. However, menu availability, ingredients, preparation methods, and allergen practices are determined solely by each venue and may change.

You are solely responsible for communicating any food allergy, intolerance, dietary restriction, or other food-related requirement directly to the restaurant staff at each venue before ordering or consuming food or beverages. Fifth Wheel does not communicate individual allergy information to venues on your behalf and is not responsible for determining whether any menu item or venue is safe or appropriate for you.

Fifth Wheel does not prepare, handle, or serve food and cannot guarantee the accuracy of ingredient information or any venue’s handling of allergens, cross-contact, food preparation, or dietary requests. If you have a food allergy, particularly a severe allergy, you should speak directly with venue staff before ordering and take any precautions or carry any medication appropriate for your needs. You are responsible for deciding what you consume.

If you have an accessibility requirement that may affect your ability to participate in an evening, please tell us when you apply. We will make reasonable efforts to select suitable venues and experiences, but not every venue or neighborhood can accommodate every accessibility need. We may therefore offer you a different evening or location.

Section 12Your information and privacy

What you share with us is central to whether this works, and we treat it that way. Our Privacy Policy describes in full what we collect, who receives it, how long we keep it, and the rights you have over it. It forms part of these Terms.

In summary: venues receive a confirmed party count and nothing else about you. Other guests see your first name and selected profile elements, and never your contact details unless a mutual match results and you choose to share them. Other guests never see your votes. We do not sell your personal information.

Section 13Content you provide

You keep ownership of the photographs, written answers, and other content you submit. You grant us a non-exclusive, royalty-free license to use that content for the purpose of operating the Service — showing your profile elements to the other four guests at your table, and to our coordinators.

We will not use your name, photograph, or words in marketing, on our website, or on social media without your separate, express, written permission. Permission given for one use is not permission for all uses, and you may withdraw it at any time going forward.

You are responsible for the accuracy of what you submit. Photographs must be recent and must be of you.

Section 14Reporting, suspension, and removal

If something happens at a table that concerns you, tell us. Every guest is given a direct channel to a coordinator, and a report goes to a coordinator only — never to the guest it concerns, and never to the rest of the table.

We may suspend or permanently remove any guest at our discretion, including while we look into a report. Removal for a conduct violation does not entitle you to a refund of any reservation fee already paid, including for an evening you have not yet attended.

We are not a law-enforcement agency and we do not adjudicate disputes between guests. If you believe you are in danger, contact emergency services by dialing #911.

Prohibited uses of the Service

In addition to Section 8, you may not: create an account for anyone other than yourself; use the Service on behalf of a business; scrape, copy, or reproduce our materials, itineraries, or venue lists; attempt to identify other guests through our systems; interfere with the operation of our website or messaging; or use the Service for any unlawful purpose.

Section 15Assumption of risk, disclaimers, and limitation of liability

Assumption of risk

You understand that Fifth Wheel arranges for you to meet strangers in person, and that meeting strangers carries inherent risk that no amount of verification eliminates. You choose to attend voluntarily and you accept that risk.

Disclaimer

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement. We make no promise about the character, conduct, intentions, marital status, or safety of any guest, and no promise that you will match, that you will enjoy the evening, or that any venue will meet your expectations.

Limitation of liability

To the fullest extent permitted by law, Fifth Wheel and its members, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost opportunity, or emotional distress, arising out of or relating to the Service. Our total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the total reservation fees you paid to us in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under Georgia law, including liability for our own gross negligence or willful misconduct.

Third parties

Venues, payment processors, identity verification providers, and rideshare and transportation services are independent third parties. We are not responsible for their acts or omissions, including food safety, service, injury on their premises, or their own handling of your information.

Section 16Indemnification

You agree to indemnify and hold harmless Fifth Wheel and its members, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your conduct at an event, your breach of these Terms, your violation of any law, or your infringement of the rights of any other guest, venue, or third party.

Section 17Governing law, disputes, and changes to these Terms

Governing law and venue

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the jurisdiction of those courts.

Chargebacks

If you dispute a charge with your card issuer rather than contacting us, we may suspend your access while the dispute is pending. Initiating a chargeback for a charge that is non-refundable under Section 6 is a breach of these Terms.

Changes

We may update these Terms. If a change is material, we will notify you by email or text before it takes effect. The Terms that apply to a given evening are the Terms in effect on the date you accepted your invitation to that evening. Continued use of the Service after a change takes effect means you accept the updated Terms.

Severability and entire agreement

If any provision of these Terms is held unenforceable, the remainder stays in effect. These Terms, together with any policy expressly referenced in them, are the entire agreement between you and Fifth Wheel regarding the Service, and replace any prior understanding. Our failure to enforce a provision is not a waiver of it.
